Law of liking the same sex is agreed to be Haram, check out the reasons!

DDHK. ORG – The act of liking the same sex as lesbian, gay, bisexual, and transgender or abbreviated as LGBT more and more discussed. Not to mention the pros and cons associated with rights human.

It is agreed that LGBT is haraam where and whenever it occurs because it includes several things, such as seeing nakedness forbidden, having sexual relations in an unlawful way, and changing Allah's creation.

LGBT in Islam is known as al-Lûthiyyah or liwath referring to the habits of the people of the Prophet Lut 'alaihissalam which violates their nature, which is an act of channeling sexual desire in a way that is forbidden both same-sex, male and male (Gay), women with women (Lesbian), as well as with the opposite sex while still liking the same sex (Bisexual).

Imam Ibn al-Hajj al-Maliki in his work explains, the level of al-Lûthiyyah or liwath behavior as follows:

اللُّوْطِيَّةُ عَلَى ثَلَاثِ مَرَاتِبَ طَائِفَةٌ تَتَمَتَّعُ بِالنَّظَرِ وَهُوَ مُحَرَّمٌ لِأَنَّ النَّظْرَةَ إِلَى الْأَمْرِ بِشَهْوَةٍ حَرَامٌ إِجْمَاعًا بَلْ صَحَّحَ بَعْضُ الْعُلَمَاءِ أَنَّهُ مُحَرَّمٌ وَإِنْ كَانَ بِغَيْرِ شَهْوَةٍ، وَالطَّائِفَةُ الثَّانِيَةُ يَتَمَتَّعُوْنَ بِالْمُلَاعَبَةِ وَالْمُبَاسَطَةِ وَالْمُعَانَقَةِ وَغَيْرِ ذَالِكَ عَدَا فِعْلَ الْفَاحِشَةِ الْكُبْرَى وَلَا يَظُنُّ ظَانٌّ أَنَّ مَا تَقَدَّمَ ذِكْرَهُ مِنَ النَّظَرِ وَالْمُلَاعَبَةِ وَالْمُبَاسَطَةِ الْمُعَانَقَةِ لُّ لِ الْفَاحِشَةِ لِ الدَّوَامِ لَيْهِ لْحِقُهُ ا لِأَنَّهُمْ الُوا لَا الْإِصْرَارِ ا اوَمَ لَى الصَّغَائِرِ ارَتْ ائِرَ…، الْفَ لاوَمَ

“Al-lûthiyyah consists of three levels; (1) The kind who vent their desires just by looking. This is still forbidden because seeing young people with lust is forbidden based on ijma'. There are even some scholars who forbid even without lust. (2) The type that vents its desires is enough by touching, rubbing, hugging and so on but not to do something heavier (with the genitals). However, this should never be taken lightly, even getting used to it can lead to something bigger. Scholars say that there is no small sin if it is done continuously, and if you get used to doing a small sin it can become a big sin….. (3) The type who actually has same-sex sexual relations.

It is clear that this act is a major sin for which the perpetrator is required to repent if he has committed it. Even in Islam, the sanction for the perpetrators of this unlawful act is the death penalty imposed by the leader of a country on the two perpetrators in order to serve as a deterrent to those who want to try to do the same thing.

Deviant LGBT

In addition, this deviant act is believed to be contagious to other people even though the perpetrators argue that this action is safer and does not pose a risk of pregnancy to the "partner".

In the hadith it is stated that the perpetrator and the object are punishable by death. The Prophet sallallaahu 'alaihi wa sallam said;

لُ لَ لُوْطٍ اقْتُلُوْا الْفَاعِلَ الْمَفْعُوْلَ
"Whoever finds the perpetrators of the actions of the people of Lut, then the perpetrator and the object will be killed"

While T (transgender) or what is termed al-Tahawwul al-Jinsî, it is necessary to see if the real intent is whether the perpetrator is a khuntsa, both musykil and non-musykil who takes medical action to confirm his status to one of the sexes, both male and female, who is more dominant according to fiqh and medical provisions.

Or is he a man who is clearly a man and then changes his male physical form to a female physical form or changes his female physical form to a male physical if he is indeed a woman.

As for the first, the essence is not transgender, but only confirms the true gender by taking medical action. While the second, deliberately changing his physical form into the physical form of the opposite sex without any reason as in the first type, only because of abnormal desires and psychological.

This is clearly forbidden because it has changed Allah's creation, even though it is under the pretext of the tendency of feelings in the soul to the opposite sex.

Ibn 'Abbas said:

لَعَنَ لُ اللهِ لَّى اللهُ لَيْهِ لَّمَ الْمُتَشَبِّهِيْنَ الرِّجَالِ النِّسَاءِ الْمُتَشَبِّهَاتِ النِّسَاءِ الرِّجَالِ

"The Messenger of Allah -peace and prayer of Allah be upon him- cursed the man who imitates himself with women and women who imitate himself with men"

In the science of jurisprudence, the redaction of curses in the verses of the Qur'an and hadith gives the legal status of haram for the actions mentioned in these verses and hadiths. May Allah protect us all from this behavior. Wallahu a'lam. [DDHK News]
