Hajj Laws for Migrant Workers Who Still Support Their Families in their Country of Origin

Allah says;

"Performing the hajj is a human obligation to Allah, namely (for) people who are able to travel to the Baitullah".

Ulama different opinions in explaining the meaning of Istithâ'ah (ability) in this verse. But it all boils down to two things, namely; Able in supplies and means of travel. As narrated by Imam Tirmidhi;

Amen ْلَ اللهِ ؛ مَا يُوْجِبُ الْحَجَّ؟ قَالَ الزَّادُ وَالرَّاحِلَةُ.

"From Ibn Umar, he said; Someone came to the Prophet sallallaahu 'alaihi wa sallam and asked, O Messenger of Allah, what makes someone obliged to perform Hajj? Rasulullah replied; Supplies and means of travel

The general meaning of this provision includes someone who is going to perform Hajj and people who must be supported, namely those who are within the scope of the object of Nafaqah al-Wujûb not Nafaqah al-Tabarru'.

Compulsory subsistence is in the form of maintenance for the wife, biological parents who do not have income even though they are capable of trying, boys who have not reached puberty or who are not yet able to work, and unmarried daughters. While tabarru' is a circumcision that is usually given by someone to such as siblings, uncles, aunts, etc.

Therefore, someone who still has obligatory dependents that must be financed so that they are not sufficient for the costs of going on their pilgrimage, they are not yet required to perform the pilgrimage because they are afraid that they will be abandoned. This is weighed against the general meaning of the following verse;

“And let fear Allah those who leave behind them weak children, whom they fear for their (well-being). therefore let them fear Allah and let them speak the truth.” Surah Ali Imran verse 97

Thus, someone who is able to pay for dependents and pilgrimage is permissible and even obliged to go on pilgrimage. Wallahu a'lam. [DDHK News]
