Getting Excess Borrowed Money, Is It Riba?

DDHK. ORG - Riba is something that is very shunned by Muslims because it is forbidden. But if you get excess money from what is lent, is that considered usury? Listen consultation with chaplain following.

Assalamualaikum warahmatullahi wabarokatuh.

Want to ask about borrowing and paying problems. I was loaned a small amount of money, but he (who borrowed it) agreed that I would pay more later.

What is the law on excess money? I already said I didn't lend money, shukron.

Greetings, Fulanah

Lending money is a noble deed, especially if the borrower really needs it. This is directly proportional to the law of being in debt, if you don't really have to, then don't owe it.

However, accounts payable is a common thing that happens in the midst of society. If it has happened, then let those who owe and owe take care of their respective manners.

Among the etiquette of people who are in debt is to immediately pay off the debt if it is able and when it is due. He is obliged to return the amount of money he borrowed. But if you return it with excess, is that permissible in Islam?

There are two kinds of laws in this matter, namely:

1. If the excess has been determined in advance, then the law is unlawful because it includes usury.

It was narrated from Ali bin Abi Talib radliyãllahu 'anhu, the Prophet shallallãhu 'alaihi wasallam said:

كُلُّ قَرْضٍ جَرَّ مَنْفَعَةً, فَهُوَ رِبًا

"Every debt that benefits from it is usury." (Al-Harith bin Abi Usama)

Ibn Qudamah Rahimahullah in his book Al-Mughni said:

Amen

"Every debt that is required is additional, then it is unlawful. This is not disputed by the scholars.

2. If the excess is not stated and not determined at the outset, but because of the pure sincerity of the borrower as a form of reciprocation, then it is permissible and even recommended.

From Abu Hurairah radliyãllahu 'anhu, he narrated that Rasulullah ﷺ once owed a camel to a man. Until some time later the person came to Rasulullah ﷺ to collect his camel. Then the Messenger of Allah asked his friends to find a camel such as to be paid to the man.

After searching here and there for the camels referred to by the Prophet sallallaahu 'alaihi wasallam, it turned out that there were none except camels whose age was more mature than the one owed by the Prophet.

So Rasulullah said:

فَاشْتَرُوْهُ فَأَعْطُوْهُ إِيَّاهُ فَإِنَّ خَيْرَكُمْ أَحْسَنُكُمْ قَضَاءً (رواه مسلم)

"Buy it and give it to him, because the best of you are the best when paying his debts." (Muslim HR)

Hope it is useful…

Peace, mercy and blessings of God
